Terms and Conditions for Fixed-Price AI Consulting
1. Provider and scope
Rum Doodle, sole proprietorship, owner Geoff Brown, Bichlnweg 9, 6370 Kitzbühel, Austria, office@rumdoodle.net, phone +43 650 2333 3585 (“we”). These terms apply to bookings of fixed-price online consultations through rumdoodle.net by consumers and businesses (“you”). Different terms apply only if we agree to them in writing.
2. Service
We provide an individual online consultation on the use of AI in your business via Microsoft Teams, within the scope booked and at the agreed appointment time. To participate, you need an internet-enabled device with a camera and microphone. The consultation is a service; no particular economic or technical result is owed. We do not provide legal or tax advice.
3. Formation of the contract
The presentation on the website is not a binding offer. By completing the booking, you make a binding offer; the contract is formed when we send our booking confirmation by email. The contract language is German or English.
4. Price and payment
The price is €390 [VAT wording pending]. Payment is due in advance through PayPal. The appointment is only considered firmly reserved once payment has been received.
5. Rescheduling and cancellation
You may reschedule once or cancel free of charge up to 48 hours before the appointment; if you cancel, we refund the full amount. If you cancel later or fail to attend without cancelling, we retain the price unless you prove that we suffered no loss or a smaller loss. Your statutory right of withdrawal (section 6) remains unaffected. If we have to cancel an appointment, we offer an alternative appointment or refund the full amount.
6. Right of withdrawal for consumers (FAGG)
Model withdrawal instructions. You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day of the conclusion of the contract. To exercise the right of withdrawal, you must inform us (Rum Doodle, Geoff Brown, Bichlnweg 9, 6370 Kitzbühel, Austria, office@rumdoodle.net, phone +43 650 2333 3585) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal. If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. If you requested that the performance of services begin during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.
Early commencement and loss of the right of withdrawal. If the appointment falls within the withdrawal period, you confirm when booking by ticking a separate box which is not pre-ticked: “I expressly request that Rum Doodle begin the consultation before the withdrawal period expires. I understand that I lose my right of withdrawal once the contract has been fully performed.” Your right of withdrawal expires when the consultation has been fully provided on this basis. We confirm this to you on a durable medium (email).

7. Liability
We have unlimited liability for intent and gross negligence and for personal injury. In cases of slight negligence, liability is limited to the agreed price to the extent permitted by law; in relation to businesses, liability for slight negligence, loss of profit and consequential loss is excluded. Mandatory consumer rights under the Austrian Consumer Protection Act (KSchG) remain unaffected. You remain responsible for implementing recommendations and using AI tools in your business.

9. Applicable law and jurisdiction
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the law of their country of residence. The court with subject-matter jurisdiction in Kitzbühel has jurisdiction; for claims against consumers domiciled or habitually resident in Austria, the court at their domicile, habitual residence or place of employment has jurisdiction (Section 14 KSchG); consumers in the EU may also sue and be sued at their place of residence.
10. Dispute resolution
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer conciliation body. Please send complaints to office@rumdoodle.net.
